Executive Summary

 

In accordance with Municipal Code Chapter 9.16.070E, Castle Rock Water seeks Town Council approval of a resolution approving a variance to the Noise Ordinance (Attachment A) to allow overnight construction work for the Craig and Gould North Infrastructure Improvements Project.  JBS Pipeline, LLC was retained by the Town to construct the project in September 2021 and began construction in November 2021.

 

In order to complete a portion of the work, the construction will require a 24-hour non-stop jack and bore operation to install storm sewer through the railroad right-of-way and partial intersection and lane closures at Sixth & Wilcox Streets for open trench installation of storm sewer in downtown Castle Rock.

 

By authorizing night work, impacts to the traveling public and businesses will be minimized.  Additionally, night work is required as per the license agreement with the Railroad.  For jack and bore operations at the railroad, this work is scheduled to take 4 days to complete.  For open trenching operations in Wilcox and Sixth Street, night work is scheduled to be completed seven days a week to reduce the overall time for traffic impacts in the downtown area.  Nightly work at Wilcox and Sixth Streets will start at approximately 7:00 p.m. and be completed by 5:00 a.m., prior to peak morning traffic for a three-week period.    

 

Staff and the Town’s contractor understand the importance of minimizing noise disturbances adjacent to residential areas during night time activities.  The project team will conduct public outreach to provide residents with advance notice of scheduled night time work. 

 

Notification and Outreach Efforts

 

Staff held multiple open houses during design and prior to construction of the project.  A monthly email notification is distributed to property owners informing them of current activities on the project during construction.

 

Staff will communicate night work activities to the public as appropriate.  Public outreach will occur in numerous forms such as; 1) direct mailings, 2) door notifications, 3) news releases, 4) Town’s web site and 5) social media.  Residents and businesses will be notified of actual dates that work is to be completed adjacent to their properties, and traffic control plans have been developed and approved to ensure worker and public safety.

 

History of Past Town Council, Boards & Commissions, or Other Discussions

 

On September 21, 2021 Castle Rock Town Council voted unanimously to approve a resolution approving a construction contract with JBS Pipeline for the Craig and Gould North Infrastructure Improvements Project.

 

On June 22, 2022 Castle Rock Water Commission was informed of this request for night work on the Craig and Gould North Project.

 

Discussion

 

The Craig & Gould North Infrastructure Improvements Project consists of upgrades to the neighborhood’s roadways, storm drainage, water, and sanitary sewer systems. In order to construct the new storm sewer system, an underground crossing of railroad right-of-way and connection to the existing storm sewer at Sixth and Wilcox is necessary to convey stormwater flows to East Plum Creek.

 

The Town Municipal Code 9.16.070.E prohibits construction noise that will create a noise disturbance from occurring between 7:00 p.m. and 7:00 a.m., Monday through Friday, and between 6:00 p.m. and 8:00 a.m., Saturday through Sunday, including holidays.  A noise disturbance is defined in the Code as a 50-decibel level or higher sound at the residential real property boundary. 

 

Attachment B depicts the location of the night work and the area of potential noise impact to adjacent properties.  The circles represent an approximate 400-foot radius area of potential impact from night work. The jack and bore operation underneath the Union Pacific Railroad is shown in red. The trench operation is shown in yellow.  The northern limit of noise disturbance is Seventh Street, the southern limit is Fifth Street, the eastern limit is Cantril Street, and the western limit is Jerry Street.  Approximately 25 residents are anticipated to be impacted by this work at one point or another.  In this circumstance, residents will be offered hotel accommodations on the select nights when work is in close proximity to their residences.  This is a continued practice of the Town to offer residents hotel accommodations during the nighttime construction activities.

 

The Craig and Gould North project started in November 2021 and is anticipated to be complete no later than August 2023.  The jack and bore operation to install storm sewer at the crossing with the railroad will begin August 8, 2022 and take approximately four days to complete.  The open trench installation of storm sewer from the intersection of Sixth and Wilcox to the railroad will take approximately three weeks to complete following pothole utility investigation and dry utility relocations.  The exact timing of the trench work is not known at this time; however, the public will be notified in advance of this work.   

 

JBS will implement the following noise and lighting controls to minimize disruptions during the work.  This includes scheduling pavement breaking during daytime hours.  Lighting will be directed away from residential property whenever possible. 

 

Due to increasing traffic volumes and the desire to limit disruption to the traveling public and normal business activities adjacent to these projects, staff seeks a variance to the existing noise ordinance to allow certain work activities outside of the authorized hours for construction.

 

Budget Impact

 

The financial impact of this action will be limited to the cost of providing residents hotel accommodations on a few of the select nights when work is in close proximity to their residences.  A minor change order is required due to the unforeseen condition of approval imposed by the railroad for 24-hour non-stop operations.  This will be covered through the project contingency authorized by Council.
