Executive Summary

 

Staff requests approval of a Services Agreement with A.G. Wassenaar Inc. (AGW) (Attachment A) for environmental remediation and consulting services required on Town-owned property at 830 N. Wilcox. The Town expects to be reimbursed by the State of Colorado Division of Oil and Public Safety (OPS) for all project costs.

 

Environmental testing occurred at this site after demolition and tank removal was complete in 2019. This testing identified contamination at the site that required environmental remediation. Remediation efforts took place in 2020 consisting of sub-surface injections of a compound used to reduce contamination levels. Subsequent site monitoring showed initial reductions in contamination levels, however recent samples show some increased levels in this area.

 

AGW has consulted the Town on the environmental issues at this site since the Town acquired the site. This environmental contamination is also tracked and monitored by the State of Colorado Division of Oil and Public Safety (OPS). AGW and OPS have agreed upon appropriate next steps to further reduce contamination levels and proceed towards potential closure of this matter with OPS.

 

Given past remediation activities and other site constraints, these additional environmental services are believed the maximum extent practicable that the Town can take to combat contamination in this area. As such, undergoing these efforts will allow the Town to apply for a Tier III risk-based closure with OPS. The Tier III closure allows for contamination to remain in place so long as it does not extend past the adjacent right-of-way. Following successful closure with the State no further remediation actions will be required. Should future construction in this area reveal contaminated soils, those soils would need to be fully removed and replaced with clean infill.

 

The proposal included in the Service Agreement in Attachment A includes costs related to additional remediation efforts, site monitoring and ongoing reporting that are all required in order to request closure of this matter with OPS. If approved, these efforts will begin in Spring 2022 and continue for approximately 18 months.

 

Budget Impact

 

AGW will provide environmental remediation services as described in Attachment A at a contract cost of $350,000 plus a 10 percent Town-managed contingency for a total authorization of up to $385,000 for this project. Funds are budgeted in the General Long-term Planning Fund to accommodate this project.

 

The State of Colorado Division of Oil and Public Safety continues to offer a reimbursement program for remediation costs that will be incurred at 830 N. Wilcox. Accordingly, actual costs for this project are expected to be reimbursed in full.

 

Staff Recommendation

 

Staff recommends approval of the Services Agreement between the Town of Castle Rock and A.G. Wassenaar Inc. for environmental remediation and consulting services at 830 N. Wilcox, totaling $350,000, to be charged to line item 136-1860-418.30-90. Offsetting reimbursement revenue will be received into this fund when received.
