Executive Summary
Castle Rock Water is seeking Town Council approval of a Resolution (Attachment A) awarding a Construction Contract with Tezak Heavy Equipment Co., Inc., for the McMurdo Gulch Stream Reclamation Priority 2 Project (Base Bid plus Bid Alternate 1) in the amount of $1,623,182.33, plus a 10% Town-managed contingency in the amount of $162,318, for a total authorization of $1,785,500.33. This project will be funded through the Stormwater Enterprise Fund and through the First Amendment to the Participation Agreement from the Cherry Creek Basin Water Quality Authority (Authority).
The project is located along McMurdo Gulch, at four sites near the intersection of Castle Oaks Drive and Autumn Sage Street. Improvements generally include stream channel improvements, boulder cascade drop structures, riffle drops, bank protection, water control, erosion-control measures, seeding, planting and other appurtenances. This Priority 2 project will mitigate impacts and preserve the natural drainageway within these areas (see Attachment B). The project is scheduled to begin in December 2021 and be completed by June 2022.

Notification and Outreach Efforts
Improvements will primarily be constructed within Town-owned open space and designated drainage easements on vacant land owned by Starwood Land Ventures. Town staff will contact residents through notification letters and provide additional notifications through news releases and social media postings as needed. Project details and updates are also provided on the Town website, CRgov.com.
History of Past Town Council, Boards & Commissions, or Other Discussions
Town Council approved Resolution No. 2020-105 approving the Participation Agreement between the Authority and Town for the Design of Stream Reclamation Improvements for the McMurdo Gulch Priority 2 Project on October 20, 2020. An amendment to this Participation Agreement in the amount of $540,000 is being presented for Council consideration concurrently with this request.
On January 7, 2020, the McMurdo Gulch Stream Reclamation Priority 2 Project design was presented to Council, at which time a design contract was awarded to Muller Engineering Company, Inc.
The Authority Board approved the First Amendment to the Participation Agreement at its September 16, 2021, meeting.
Castle Rock Water staff presented this construction contract to the Castle Rock Water Commission at the meeting held on December 1, 2021, and the Castle Rock Water Commission voted unanimously to recommend Town Council approval.
Discussion
McMurdo Gulch is a western tributary to Cherry Creek, extending along the eastern edge of the Town. The entire McMurdo Gulch channel is approximately 6.7 miles long from the headwaters to the confluence with Cherry Creek and encompasses a tributary area of approximately 6.5 square miles. The 2011 reclamation plan focused on areas where the channel was experiencing stream degradation associated with head-cutting, failing berms with minimal vegetation, steep banks and incised channel areas. These areas of degradation were separated by healthy and stable segments of stream that had not experienced degradation yet. This surgical approach has shown tremendous success and has demonstrated a measurable improvement to nutrient concentrations through the Authority’s annual monitoring program.
The Authority was a funding partner with the Town for the design and construction of the 2011 McMurdo Gulch project. The project cost totaled approximately $1.5 million, of which the Authority contributed $630,000. As part of the 2011 project, the Town and the Authority identified a need to assess stream conditions on a regular basis to determine when future improvements would be needed. The Town conducted a stream assessment in 2017 following significant growth in the upper headwaters of McMurdo Gulch.
Based on the Report summary, the Stormwater Division prioritized design of the recommended stream improvements in 2018 at four locations where the channel was experiencing stream degradation. The total length of these four areas was approximately two thousand lineal feet. Stream reclamation construction began in December 2019 at a total project cost budget for design and construction of approximately $1.677 million, of which the Authority contributed $420,000.
The Stormwater Division prioritized design of additional recommended stream improvements in 2019/2020, with construction of the improvements proposed in 2021 and 2022. This Priority 2 project includes four locations (approximate length of 3,100 lineal feet) where the channel is experiencing stream degradation. Following approval of the design documents, the project was advertised for public bid from qualified contractors on October 22, 2021, on the Town’s Rocky Mountain Bid Net site. Bids were received from thirteen contractors on Friday, November 12, 2021. Upon review of the bids, project budget and project scope, Stormwater staff decided to proceed with award and construction of the Base Bid and Bid Alternate No. 1 for the project. Bid Alternate No. 1 included additional soil riprap bank protection at a location where Black Hills’ gas line is located close to the channel improvements, and additional coir mat bank protection was added in three locations along a wetland channel graded bench, to further armor the floodplain bench.

Tezak Heavy Equipment, Co., Inc., is the confirmed low bidder, having also met the qualification requirements under the contract. Tezak is prequalified as a Category 1 contractor with Mile High Flood District. Their qualification package included multiple stream reclamation/channel stabilization projects for public entities including Mile High Flood District. Muller Engineering, the design engineer for this project, provided a positive recommendation for Tezak on a recent similar project on Big Dry Creek in Westminster. Construction is anticipated to begin in December 2021 and be substantially complete by July 2022, weather permitting.
Budget Impact
Funds for this Construction Contract will be charged to the Stormwater capital account below. Additionally, the Town has requested construction funding from the Authority in the amount of $540,000. The Authority Board reviewed and approved this funding through the First Amendment to the Participation Agreement at their September 16, 2021 Board meeting.
