Executive Summary

 

In accordance with Municipal Code Chapter 9.16.070E, Castle Rock Water is seeking Town Council approval of a variance to the Noise Ordinance (Attachment A) to allow three nights of overnight construction work in December for the Village North Drainage and Infrastructure Improvements Project.  T. Lowell Construction, Inc. (T. Lowell) was retained by the Town to construct the project in January 2021 and began construction in February. 

 

In order to complete the project, T. Lowell needs to relocate multiple waterlines in Malibu and Park Street (see Attachment B for location map).  The relocation construction will require shutting down the waterlines, which will put multiple businesses out of water.  The work will be completed between 7pm and 7am to minimize business disruptions.  T. Lowell will complete the overnight work in three nights or less during December.  All customers that will be impacted by the water shut-offs and night work will be notified in advance of the work. 

 

History of Past Town Council, Boards & Commissions, or Other Discussions

 

On January 5, 2021 Castle Rock Town Council voted unanimously to approve a resolution approving a construction contract with T. Lowell Construction for the Village North Drainage and Infrastructure Improvements Project.

 

On December 1, 2021 Castle Rock Water Commission was presented information regarding this request for night work on the Village North Project. 

 

Notification and Outreach Efforts

 

Castle Rock Water will contact impacted customers with mailed letters and door hangers in advance of the water shut-offs.  Staff will coordinate with each owner to verify work is outside of open business hours and address any specific needs on a case-by-case basis to minimize business disruptions from the work.  The nearest residential structure is approximately 1,000 feet from the work activity, and there is a local hotel within 600 feet of the work.  It is not anticipated that the night work activity will generate noise disturbance that crosses into residential areas. Castle Rock Water will contact the local hotel and private residences within a ¼ mile prior to the work to notify them of the potential disturbance.      

 

Discussion

 

This Village North Drainage and Infrastructure Improvements Project was initiated to improve storm, sanitary sewer and street infrastructure within the Village North area, north of Wolfensberger Road and east of the BNSF railroad tracks.

 

Through a competitive bidding process, T. Lowell was retained in January 2021 to complete construction of the project.  Construction began in February and progressed through August.  Unanticipated utility conflicts with CORE electric Infrastructure in Town right of way resulted in delaying the project in September and October.  CORE electric completed relocation of conflicting infrastructure, and T. Lowell subsequently resumed construction in early November.  The project is approximately 70% complete, with stormwater and some minor water and sanitary sewer work remaining in Malibu and Park Streets, along with final surface paving improvements.

 

In order to accommodate installation of the new storm sewer system, multiple waterlines in Malibu and Park Street must be relocated.  The relocation construction will require temporarily shutting down the waterlines, which will disrupt water service for approximately 35 customers.  In accordance with Castle Rock Water policy, no waterline shutoffs are allowed during business hours in a non-residential area that impact commercial customers.  Additionally, the risk of disruption due to noise is far less than the impact of daytime water service disruptions to these local businesses.  Therefore, staff is requesting work be completed on weeknights between 7pm and 7am in December.  This variance is not requesting any authorization for nightwork on weekends or holidays.  Depending on existing conditions encountered, the construction work may be completed in as little as one night, but Council authorization for up to three nights is requested.

 

Budget Impact

 

If there are any additional contractor cost requests related to the night work, staff will negotiate reasonable and appropriate amounts prior to commencement of the work.

 

Staff Recommendation

 

Staff requests Council approval of a Resolution approving a variance pursuant to Chapter 9.16.070E of the Castle Rock Municipal Code for the Village North Drainage and Infrastructure Improvements Project.
