Executive Summary

 

The Town was contacted in January 2021 by Crystal Valley Metro District #1 (District) regarding, among other items, ownership of a parcel located near Crystal Valley Parkway and Loop Road. This parcel is 1.748 acres in size and is located within Town boundaries as shown outlined in green on the map in Attachment B. The parcel is adjacent to other Town-owned property and includes an asphalt access road to a Town lift station plus a portion of right-of-way on Crystal Valley Parkway. District has expressed interest in conveying this parcel to the Town as part of their efforts to dissolve the district in the near future.

 

Town Department Heads and staff were informed of this potential parcel conveyance in March 2021. No potential issues or concerns were raised as part of this review. Additionally, results of a title search performed at that time did not raise any areas of concern should the Town accept ownership of this parcel.

 

The Town can acquire property as demonstrated in Section 14.02.020 of Town Code as shown below.

 

The Town may acquire real property by deed, grant or by other conveyance instrument, or as prescribed in 14.02.030. The grantee in all such conveyances shall be designated as the "Town of Castle Rock, a municipal corporation," although the failure to make such designation shall not impair the vesting of title in the Town under an otherwise valid conveyance. At the Town's request, the grantor shall furnish the Town with an ALTA form policy of title insurance, issued by a title company licensed to do business in the State of Colorado, and which insures the Town's title in an amount equal to the value of the subject parcel.

 

Code does not stipulate an administrative process for property acquisition and allows real estate transactions to be handled administratively by the Town Manager (§14.02.060). However, staff wishes to provide Town Council an opportunity to consider acceptance of this parcel on behalf of the Town.

 

Acceptance of this parcel is not expected to impact Town operations or result in additional financial obligations. The Town already maintains the portion of this parcel that is in the right-of-way as well as the access road to the lift station facility. Given the small size of the parcel and adjacency to existing Town-owned property, any actual impacts related to owning this additional parcel would likely be minimal. Additionally, the median area that is located on this parcel would remain the responsibility of the District.

 

Staff recommends accepting conveyance of this parcel as outlined in the attached resolution.
