Update:  Administrative Easement Grant and Right-of-Way and Easement Abandonments

Executive Summary

 

This update is provided to Town Council to summarize the right-of-way abandonments, easement abandonments and easement grants processed administratively by Town staff from September 2019 thru July 2020.  Pursuant to Ordinance No. 2018-008 adopted on April 17, 2018, unimproved street right-of-way abandonments and utility easement abandonments may be approved by Town staff in conjunction with subdivision approval.  These abandonments are typically approved on the face of plats such as the ones listed in this memorandum.  In addition, pursuant the same Ordinance No. 2018-008, easements may be granted administratively by Town staff via an easement agreement executed by the Town Manager and Town Attorney, provided that the Town receives only nominal consideration for such grant.

 

Staff will update this report when new easement grants and right-of-way and easement abandonments are approved, as Town Council requested.

 

New Right-of-Way Abandonments

 

Founders Village Filing No. 24, Amendment No. 1, a portion of the unimproved Edge Cliff Street right-of-way and utility easements that were created with Founders Village Filing No. 24, recorded at Reception No. 2006064806, were abandoned for a revised right-of-way with a new configuration of lots. The subdivision plat was amended and recorded at Reception No. 2019079490 (Attachment A).

 

New Easement Abandonments

 

The following easements were abandoned by the subdivision plats listed below, which were recorded from September 1, 2019 through July 31, 2020:

 

Castle Oaks Estates Filing No. 4, Amendment No. 3 Plat - A utility easement that was created with Castle Oaks Estates Filing No. 4, Amendment No. 1 Plat, recorded at Reception No. 2014055922 and an easement created by agreement recorded at Reception No. 150566, were abandoned and replaced with revised utility easements with the plat amendment plat recorded at Reception No. 2020047318 (Attachment B).

 

The Meadows Filing No. 20, Phase 2, Amendment No. 8 - A utility easement that was created with the Meadows Filing No. 20, Phase 2, Amendment No. 7, recorded at Reception No. 2018029183, was partially abandoned and replaced with a revised utility easement with the plat amendment plat recorded at Reception No. 2019079495 (Attachment C).

 

The Meadows Filing No. 17, Area No. 4, Amendment No. 11 Plat - A slope easement that was created with an agreement recorded at Book 1432, Page 1037 was abandoned with the plat amendment plat recorded at Reception No. 2019086982 (Attachment D).

 

Promenade at Castle Rock, Filing No. 1, Amendment No. 17 - Two utility easements that were created with Promenade at Castle Rock, Filing No. 1, Amendment No. 11 plat, recorded at Reception No. 2016037682, were abandoned and replaced with revised utility easements with the plat amendment plat recorded at Reception No. 2019059895 (Attachment E).

 

New Easements Granted

 

The following easements were granted by the easement agreements listed below, which were recorded from September 1, 2019 through July 31, 2020:

 

Utility Underground Easement to IREA - Easement on Town property located on South Ridge Road within a Town water tank site. Recorded at Reception No. 2019082072 (Attachment F).

 

Utility Underground Easement to IREA - Easement on Town property located within a Meadows Subdivision adjacent to Wolfensberger Road west of Coachline. Recorded at Reception No. 2020012786 (Attachment G).

 

Utility Underground Easement to IREA - Easement on Town property located within the Oaks Subdivision west of Ridge Road and Appleton Way.  Recorded at Reception No. 2020052723 (Attachment H).
