Executive Summary

 

Since the City of Castle Pines has requested to be a member of the Douglas County Housing Partnership (DCHP), the DCHP is proposing to amend and reinstate the existing Intergovernmental Agreement (IGA).  On June 16, 2020, staff presented the draft Amended and Restated IGA for Town Council review and received no comments.  Other members of DCHP requested minor grammatical and/or semantic changes for clarification since Council reviewed the draft IGA in June; however, the substance remains the same.

 

Discussion

 

The DCHP Board reviewed the existing IGA between the various member jurisdictions as part of the City of Castle Pine’s interest in joining DCHP.  The current members include Douglas County, City of Lone Tree, Town of Parker, and the Town of Castle Rock.  Approved in 2003 and amended in 2013, the current IGA contains bylaws, which are now a separate document.  The IGA is also due for an update based on Colorado Statute for multijurisdictional authorities.  The DCHP’s attorney and the DCHP Board of Directors revised the IGA (Attachment A, Exhibit 1) to remove the bylaws and to add the required language per the Colorado Statute.  The attached Amended and Restated IGA reflects minor grammatical and semantic revisions that other jurisdictions’ attorneys requested from the draft that staff presented to Council on June 16, 2020.  The Town’s legal team reviewed the revisions and had no concerns.  Please note that Section 7.01.g includes required Colorado Statute language regarding DCHP’s authority to condemn property.  DCHP would only use their condemnation authority within the Town of Castle Rock with the Town Council’s concurrence.  Staff does not have concerns with the proposed changes, as the revisions are non-substantive. 

 

Budget Impact

 

The Town’s yearly contribution of the DCHP’s budget will remain at $35,000.

Staff recommends approval of this resolution.
