Update: Administrative Easement Grant and Right-of-Way and Easement Abandonments

Executive Summary

 

This update is provided to Town Council to summarize the right-of-way abandonments, easement abandonments and easement grants processed administratively by Town staff during the first half of 2019.  Pursuant to Ordinance No. 2018-008 adopted on April 17, 2018, unimproved street right-of-way abandonments and utility easement abandonments may be approved by Town staff in conjunction with subdivision approval.  These abandonments are typically approved on the face of plats such as the ones listed in this memorandum.  In addition, pursuant the same Ordinance No. 2018-008, easements may be granted administratively by Town staff via an easement agreement executed by the Town Manager and Town Attorney, provided that the Town receives only nominal consideration for such grant.

 

New Right-of-Way Abandonments

 

There were no right-of-ways abandoned from January 1, 2019 through August 31, 2019.

 

New Easement Abandonments

 

The following easements were abandoned by the subdivision plats listed below, which were recorded from January 1, 2019 through August 31, 2019.

 

Castle Rock Health Campus, Second Amendment - A utility easement that was created with the Castle Rock Health Campus, recorded at Reception No. 199645871, was partially abandoned and a drainage easement recorded at Book 1120, Page 290, was abandoned with plat amendment recorded at Reception No. 2018041090 (Attachment A).

 

New Easements Granted

 

The following easements were granted by the easement agreements listed below, which were recorded from January 1, 2019 through August 31, 2019.

 

Utility Underground Easement to IREA - Easement on Town property located within the Centennial Park adjacent to the South Street public right-of-way (Attachment B).

 

Utility Overhead Easement to IREA - Easement on Town property located within the future Crystal Valley Ranch/Interstate I-25 interchange area north of Crystal Valley Parkway and adjacent to the I-25 Frontage Road (Attachment C).

 

Access Easement to Calvary Chapel Church - Easements on Town property located adjacent to the Canyons Drive public right-of-way (Attachment D).

 

Drainage Easement to Brookside Skilled Nursing Facility - Easement on Town property located within the Castle Rock Health Campus subdivision, southerly of Safeway on Perry, adjacent to the new East Plum Creek Trail (Attachment A).
