Resolution Approving a Construction Contract with 53 Corporation, LLC, for the Plum Creek Parkway Roadway and Widening Improvements Phase 1A - Storm Sewer Project

Executive Summary
The purpose of the memo is to request Town Council to approve a Resolution approving a Construction Contract (Attachment A) with 53 Corporation LLC, for the Plum Creek Parkway Roadway and Widening Improvements Phase 1A - Storm Sewer Project. The work to be performed under this contract includes installation of new storm sewer pipe from 18 inches to 54 inches, drainage inlets and manholes, removal of existing concrete, hot mix asphalt patching, erosion control, and landscape restoration along Plum Creek Parkway from Gilbert Street to Eaton Street.
The design for the full widening from Gilbert Street to Ridge Road is 95% complete and is scheduled to be finalized by the end of November. The widening work will be completed in two different phases. The first phase is between Gilbert and Eaton Streets, which is planned for completion in 2020. The second phase is between Eaton Street and Ridge Road, and is currently being recommended to be completed in 2021. We are currently in process of acquiring the necessary right-of-way (ROW). The timing of the completion of this acquisition is estimated to be completed in the winter at the latest. We currently estimate that once the ROW is acquired; it will be late this year to bid the complete first widening phase. The roadway portion of construction would occur during the winter months which is not ideal for construction.
The advancement of a breakout underground storm sewer package will allow the construction of the new storm sewer located within the existing right-of-way to take place this year. Construction of this package will take place during the winter months and is scheduled to be complete by the end of January 2020. Approval of this package would reduce the construction time of the final roadway portion between Gilbert and Eaton streets by four months. Benefits of this separate underground drainage package are as follows:
• Allows all other utilities to be relocated during the same time as the drainage package.
• Allows time to complete the acquisition of right-of-way for the remainder of the proposed project.
• Allows roadway construction to be a standalone package that can begin earlier in the spring of 2020 and be completed before winter.

The Public Works Commission is scheduled to review this item on September 9, 2019. They will provide a formal recommendation to Town Council, which staff will be providing during the presentation at the Town Council Meeting.
Discussion
The Invitation for Bid was advertised on BidNet August 13, 2019. Bids were opened August 27, 2019. The summary of bids received are located in the “Financial Impact” section below.
Public Works Staff has coordinated with Community Relations on a communications plan for this project (Attachment C). After Council considers approval of the construction contract, staff will begin communication with targeted audiences, focusing on the key messages defined in the plan using CRgov.com, news releases, email, mail and social media.
Budget Impact
The construction cost has been included in the project’s 2019 budget and will be expensed as follows:
• Account Number 135-3175-431.77-05 Plum Creek Pkwy Widening (East) in the amount of $873,990 plus a Town managed contingency of 10% for a total cost of $961,389
• Account Number 135-3175-431.78-82 Plum Creek and Gilbert Roundabout in the amount of $179,010 plus a Town managed contingency of 10% for a total cost of $196,911
For a Total project encumbrance of $1,158,300

Staff Recommendation
Staff recommends the Town Council approve the Resolution as introduced by Title. The formal recommendation from the Public Works Commission will be provided during the staff presentation.
