Executive Summary

 

The purpose and intent of this report is to provide Town Council with a summary of quasi-judicial projects.  In order to provide all parties with due process under law, decision makers must be fair and impartial when considering quasi-judicial applications such as those attached to this memorandum (Attachment A).

 

Many of the attached projects do not have public hearing dates yet, but Town Council could be asked to consider them in the future.  The Town’s Development Activity map provides information on staff-reviewed applications and applications already approved by Town Council.  Those applications can be found at:  CRgov.com/ <http://www.crgov.com/inyourbackyard>developmentactivity.

 

New Applications

 

Acme Brick Rezoning I-2 to Interchange Overlay PDThe ACME Brick Company located at 401 and 661 Prairie Hawk Drive is currently zoned I-2 (Industrial).  The site is approximately 40 acres.  The applicant is requesting to rezone the property to Interchange Overlay PD that has established use and zoning requirements.  A public hearing on this application will be required before the Planning Commission and Town Council.  The site is located within Mayor Pro Tem Bower’s District.

 

418 N Lewis Street New Garage and ADUThe property owners, George Usleber and Robin Winokur, are proposing to add a new, detached garage and Accessory Dwelling Unit (ADU) on the northeast corner of the property.  Town Council has already approved the Use By Special review application for the ADU thus leaving the Historic Preservation Board to review and make a determination upon the request.  The project is located within Mayor Pro Tem Bower’s District.

 

620 Second Street - House Addition:  The property owner of 620 Second Street submitted a landmark alteration certificate application for an addition to the locally landmarked home located on the southwest corner of Second and N. Lewis Streets.  Landmarked in 1998, the home is better known as Kirk House and was built in 1882.  The application includes renovating the existing windows, adding a front porch, adding a side deck, and a small addition on the west and south sides of the house.  The project is within Mayor Pro Tem Bower’s district.

 

Memmen Young Infill PD Major Amendment The property owner’s representative, Highline Engineering & Surveying, has submitted an application for a major amendment to a 176.5 acre portion of the Memmen Young Infill PD.  Approved in 1985, the Memmen Young Infill PD is west of Ridge Road, south of Fifth Street, and north of Plum Creek Parkway.  The portion of the Memmen Young Infill PD under consideration currently allows 410 single-family units and 476 multi-family units.  The applicant is proposing new zoning that would allow 377 single-family units and 260 duplex units (130 structures) with 81 acres of open space.  The applicant is referring to the project as Founders Vista.  The major amendment will require public hearings before the Planning Commission for review and recommendation and Town Council for review and final decision.  The project is located in Councilmember Teal’s district.

 

Caliber at Terrain Site Development Plan:  The Garrett Companies, on behalf of Poplar Investments, Inc., has submitted an application for a site development plan for an apartment building complex known as Caliber at Terrain, which is located in the northeast quadrant of Founders Parkway and State Highway 86.  The SDP proposes 21 two-story apartments buildings containing 226 residential units, a clubhouse/leasing office, a pool, and a dog park.  Parking is provided via 204 attached garage spaces and 212 surface parking spaces.  The SDP will require public hearings before the Planning Commission for review and recommendation and Town Council for review and final decision.  The project is located in Councilmember Townsend’s district.
