Discussion/Direction: Vaping Ordinance

Castle Rock PD, Teen Court, and Municipal Court are suggesting a revision of our tobacco minor in possession Code because the current Code does not address electronic cigarettes and vaping devices, which have become increasingly popular amongst the youth in our community. This is an everyday issue at Castle Rock schools and our peer jurisdictions in Douglas County have legal provisions for addressing this, unlike Castle Rock. Updating Town Code to include possession of tobacco paraphernalia by a minor as an offense would allow for a unified approach to addressing this issue between both Castle Rock high schools. Please see the attached letters from the schools supporting the proposed ordinance. The Town has recently received support from various schools aware of a possible Town ordinance. Would Council like to authorize Town staff to prepare an ordinance for consideration?
Proposed Motion
“I move to direct staff to prepare an ordinance amending the Castle Rock Municipal Code to address electronic cigarettes and vaping devices by minors, to be presented on an upcoming agenda for first reading.”
