Resolution Approving an Amendment to the Service Plan for the Bella Mesa Metropolitan District [located in vicinity of Founders Village and Castlewood Ranch off of Mikelson Boulevard]

Executive Summary
Please see the attached letter from counsel for the Bella Mesa Metropolitan District. A potential purchaser of a large portion of the property within the District’s service area desires assurance that it can exclude the property from the District boundary before it exercises its option to purchase. This Resolution permits that exclusion, but disables the District from undertaking any activity, other than routine maintenance, until it seeks and obtains from Town Council a service plan amendment that reflects the reduced scope of the District and a current capital and financial plan. In short, this avoids processing a service plan amendment prior to the exclusion, in deference to the fact that the exclusion may not in fact take place.
Staff Recommendation
Staff recommends approval of the amendment.
