Executive Summary

 

The purpose of the memo is to request Town Council to approve of a Resolution approving a Construction Contract (Attachment A) with Rocky Mountain Excavating, Inc., (“RME”) for the Wolfensberger Road / Plum Creek Parkway Roundabout Project.  This project will construct a new roundabout located at the intersection of Wolfensberger Road and Plum Creek Parkway replacing the existing intersection controlled by stop signs in all four directions. 

 

Chavez Construction Inc., was the low bid for this project.  Chavez Construction also was the low bid on the Town of Castle Rock’s 2018 Asphalt Overlay and Full Depth Reclamation project and their bid was rejected for the following reasons:

                     The Town of Castle Rock recently contracted with Chavez Construction Inc. for the 2017 Reconstruction project of Emerald Drive, Prestwick Way, and October Place.  Chavez Construction was assessed 4 days of liquidated damages in the amount of $7,000 for not completing the scope of work within the allotted contract days.  There were many days where only one or two Chavez Construction employees were on-site, even though the weather would have permitted work.  One of the references checked made the comment, “Chavez didn’t seem to have enough people to do the projects they were contracted to do.”  This is also a complaint that Town staff had during the PMP project.

                     A physical altercation between Chavez employees, resulting in bodily injury transpired during the project, and within the project limits.  This created a hostile environment for the Town of Castle Rock’s residents that lived adjacent to the project, as several observed the confrontation.  Town of Castle Rock employees working on the project also felt a perceived threat.  This is behavior unbecoming to the professionalism of the Town of Castle Rock and is unacceptable. 

                     Town staff working on the project also reported a continuous issue with the approved traffic control plans not being setup correctly.

In accordance with the Town of Castle Rock’s Information and instructions to Bidders, Section 18, ‘The Town of Castle Rock reserves the right to cancel this invitation to Bid, reject any Bid, in whole or in part, to adjust the quantity of work to be done as mandated by budgetary requirements, and to waive informalities or irregularities in the Bids received; when it is in the Town’s best interest to do so.   

With the Town’s recent experience with Chavez Construction Inc., staff recommends that the contract for the construction of the Wolfensberger Road / Plum Creek Parkway Roundabout be awarded to the second low bid submitted by RME in the amount of $1,496,385.45.  This bid amount is $133,941.65 more than the low bid from Chavez Construction Inc., or less than 9%.

 

RME is a reputable firm that has successfully completed projects to a similar scope and nature.  In addition RME has successfully completed the 2016 and 2017 Town Facility Parking Lot Improvement Projects.  Staff has received excellent references from other local governments including Douglas County Public Works.

 

History of Past Town Council, Boards & Commissions, or Other Discussions

 

Public Works Commission is scheduled to review this item on May 7, 2018.  They will provide a formal recommendation to Town Council, which staff will provide during the presentation at the Town Council Meeting.

 

Discussion

 

The Invitation for Bid was advertised on BidNet on February 7, 2018.  Bids were opened March 15, 2018.  

 

Public Works staff has coordinated with Community Relations on a communications plan for this project (Attachment B). Broadly, the plan has two goals. First, inform the traveling public in the area of the new roundabout at Wolfensberger and Plum Creek Parkway, including benefits of the roundabout and construction timing. The secondary goal is to improve negative perception about roundabouts. Engineering science proves roundabouts increase efficiency and safety at an intersection, and we want public perception to catch up to the benefits and efficiencies of roundabouts. After Council considers approval of the construction contract, staff will begin communicating with targeted audiences, focusing on the key messages defined in the plan using CRgov.com, news releases, email, mail and social media.

 

Staff expects to issue the Notice to Proceed in early July with a 94 calendar day contract giving a completion date in the fall.

 

Budget Impact

 

The construction cost for this project has been budgeted and will be expensed to Account Number 135-3175-431.78-67 in the amount of $1,496,385.45 plus a Town managed contingency of 10% for a total project cost of $1,646,024.

Staff Recommendation

 

Staff recommends the Town Council approval of the Resolution as introduced by Title.  The formal recommendation for the Public Works Commission will be provided during the staff presentation.
