Executive Summary
The regulation of the sale and use of consumer fireworks is contained in two sections of the Municipal Code; Section 8.26.040 pertaining to open burning and open fire and Section 15.18.030 pertaining to the use and sale of consumer fireworks. The amendments provided here to Section 8.26.040 helps clarify the impact of fire restrictions on the sale and use of fireworks and to include all Town departments that have administration and enforcement authority (the current language only lists the Fire Department).

The amendment was presented to the Public Safety Commission on November 2nd and the Commission voted unanimously in support of the amendment 8-0.
Discussion
When fire restrictions were enacted during the summer of 2016, there was some confusion on the allowance or prohibition of the sale and use of consumer fireworks during the 4th of July holiday. To remedy the confusion, the Police and Fire Departments developed a solution that would resolve the confusion via a simple language change to Section 8.26.040 of the Municipal Code.
The proposed amendments include the clarification that open burning by definition is not allowed during Stage 1 fire restrictions in Section 1; delineates between use OR sale of fireworks during Stage 2 fire restrictions in Section 1; references Section 15.18.030 of the Municipal Code that allows the discharge of fireworks only on the 4th of July only between the times of 8:00 and 10:00pm in Section 2; and adds the Police Department and Town Manager as responsible for the administration and enforcement of this chapter in Section 3.
