PUBLIC HEARING - SECOND READING

 

The Town Council will now consider a request for the approval of an Ordinance Annexing to the Town of Castle Rock, Colorado a 5.4346 Acre Parcel Located in the Southwest ¼ of Section 1, Township 8 South, Range 67 West of the 6th Principal Meridian, Douglas County, State of Colorado (Second Reading - Approved on First Reading on June 6 with a vote of 7-0) [Calvary Chapel Annexation - 5th Street and Woodlands Boulevard] on second reading.  This agenda item was considered at first reading as a quasi-judicial hearing and is presented tonight for second reading. 

 

If any Councilmember needs to address Council tonight regarding any potential conflict of interest or other matter that was not raised at first reading, please address the Council at this time.

Executive Summary

 

Town Council heard this application at the June 6, 2017, public hearing and approved the annexation and PD zoning on first reading.

 

As the Town of Castle Rock continues to grow, small parcels of land exist that are primarily surrounded by Town property.  It is in the interest of the Town to review the incorporation of such parcels into the Town’s jurisdictional boundaries, if requested, determining if the land and associated use promotes the Town’s vision of careful planning to accommodate the needs of existing and future residents. 

 

The proposed Annexation parcel of 5.4± acres is located at the northwest corner of Fifth Street and Woodlands Boulevard.   It is comprised presently of two parcels located within Douglas County and identified as follows:

 

The annexation process would provide the parcel with Town services. 

 

The property has been reviewed by Town Council in two hearings as prescribed by State statute; a Substantial Compliance hearing on May 3, 2016, and an Eligibility hearing on June 21, 2016.  The Town Council has found that the annexation proposal is in substantial compliance with Section 30 of Article II of the Colorado Constitution and has met the required statutory findings concerning the eligibility for annexation.  The present annexation process is for the Town Council to determine if it is in the community’s best interest to annex the property.

 

On April 27, 2017, this annexation proposal was heard by the Planning Commission.  One citizen commented in favor of the annexation.  The Commission voted 4-0 to recommend approval to the Town Council.  On June 6, 2017, this proposal was heard by Town Council and the Council voted 7 to 0 to approve the annexation.

 

 

Budget Impact

 

The proposed annexation will generate review fees.  Zoning and site development impact fees will offset costs to the Town of Castle Rock at a later date.

 

Staff Recommendation

 

Based on the analysis and findings outlined in this report, the Planning Commission and staff recommends approval of the proposed Calvary Chapel Castle Rock annexation.

I move to approve the Ordinance as introduced by Title, second reading.
