Resolution Approving the Second Amendment to Auburn Ridge Annexation and Development Agreement

Executive Summary
The purpose of this report is to seek Town Council approval of an amendment to the Auburn Ridge Annexation and Development Agreement (DA) to incorporate the property owner’s obligations to make improvements to the Omni Gulch where it is adjacent to Auburn Ridge, Lot 2 (Attachment A). The Annexation and Development Agreement, as amended, is intended to provide for public health, safety, and welfare.
Staff recommends approval of the proposed amendment.
History of Past Town Council, Boards & Commissions, or Other Discussions
An overview of the proposed amendment to the DA was presented to Town Council on August 4, 2015, along with the first reading of the proposed rezoning of Auburn Ridge, Lot 2. No action on the DA amendment was required or taken at that time.
The second reading of the rezoning and consideration of the DA amendment as an action item before Town Council was postponed until the final details of the DA amendment were determined.
Discussion
The proposed Annexation and Development Agreement amendment contains the following new provision.
Omni Gulch Tributary Improvements:
The property owner will be required to make drainage channel improvements to the Omni Tributary adjacent to the property consistent with the recommendations of the Omni Industrial and Westfield Watershed Master.
Budget Impact
No immediate budget impact.
Staff Recommendation
The proposed DA amendment promotes public health, safety and welfare by defining property owner obligations for improving an active drainage channel. Staff recommends approval.
