Resolution Setting a Date for the Public Hearing on the Establishment by Ordinance of the Proposed Miller’s Landing Business Improvement District

Executive Summary

 

Proponents of the proposed Miller’s Landing project have filed a petition seeking formation of a Business Improvement District (BID) on 61 acres at the northwest corner of I-25 and Plum Creek Parkway (see the attached vicinity map). Under statutory BID provisions, the Town Council is required to set within a prescribed timeframe a public hearing to consider adoption of an ordinance creating the proposed Miller’s Landing District. This Resolution acknowledges receipt of a petition with the required information and fixes the hearing date. Adoption of the Resolution does not obligate the Council to approve formation of the District.

 

A BID is a separate local government, similar to a metropolitan district, with the authority to levy property taxes and issue debt. The Council may serve as the Board of Directors or the Board may be appointed by the Council, which is proposed by the proponents here. The BID proposal is part of the URA and other development or financial discussions with the proponents on the Miller’s Landing project. The proponents are urging the consideration of the BID prior to resolution of those discussions in order to preserve the opportunity to place a debt authorization measure on the November ballot.

 

Staff will present an analysis of the District proposal with consideration of the ordinance on first reading on September 6th

 

Staff Recommendation

 

Staff recommends approval of the Resolution as presented, setting the public hearing for first reading of the ordinance establishing the proposed Miller’s Landing Business Improvement District for September 6, 2016 at 6:00 P.M.
