Executive Summary
The Utilities Department is seeking Town Council approval of a Resolution (Attachment A) awarding a Construction Contract (Exhibit 1) to 53 Corporation, LLC for the East Plum Creek Stabilization (EPC) at Meadows Parkway Project in the amount of $563,435 plus a 10% staff-managed contingency in the amount of $56,344, for a total project authorization of $619,779. This project is required to protect an existing 16-inch water main that crosses EPC at Meadows Parkway and provide stream stabilization on EPC (see Attachment B). As such, the project will be joint funded through the Stormwater and Water Enterprise Funds. The project is scheduled to be completed by the end of May.
Notification and Outreach Efforts
The 16-inch water main is located in a Utility Easement on private land owned by Castle Rock Development Company (CRDC). The Town has worked closely with CRDC on this project and is in the final process of securing a license agreement for project access.
History of Past Town Council, Boards & Commissions, or Other Discussions
Town Council was briefed on this project as part of the June 2015 Flood Report on August 18, 2015.
Utilities staff presented this construction agreement to the Utilities Commission at their meeting held on March 29, 2016 and Utilities Commission voted unanimously to recommend approval.
Discussion
A 16-inch water main that crosses EPC s was installed in 1992 as a development effort to serve the Meadows subdivision. The water main was protected on the downstream side with a low flow cut-off wall. In May 2015, the Town became aware of a potential risk to the water main from active stream erosion in EPC. High flows along EPC in June 2015 exceeded the design capacity of the low flow cut-off wall, which resulted in flow around the end of the sheet pile instead of over the top.
Town Operations and Maintenance Staff were able to mobilize quickly to place large sand bags between the sheet pile and eroded bank to redirect flow back over the top of the sheet pile in an effort to maintain approximately 3 feet of remaining stream bed cover over the water main. This effort was an emergency response to minimize the impacts to the water main until the permanent stabilization improvements are constructed.
The Town initiated design of a formal high flow grade control to provide long-term protection for the existing water main. This improvement was identified in Stormwater Master Plan at a future date; however, multiple high flow events on EPC have accelerated the need for this infrastructure. Improvements include a new sheet pile cut-off wall, to be installed the width of the 100-year floodplain. Also included is soil riprap bank protection to minimize the risk of erosion around the east end of the proposed sheet pile.
The Town solicited construction bids via Rocky Mountain BidNet. Bids were received from two qualified contractors and Phase I pricing is summarized below:

We recommend this project be awarded to 53 Corporation, LLC as the confirmed lowest qualified bidder. 53 Corporation, LLC has completed similar work for the Town over the past several years. Construction is anticipated to begin in April and will be substantially complete by May 2016, weather permitting.
Budget Impact
This project will be jointly funded through the Stormwater and Water Funds. Funds are available in the amount of $310,000 from the Stormwater Fund Capital Reserve and in the amount of $310,000 from what was the Meadows Capital Reserve (now part of the Water Fund Capital Reserve), for a total of $620,000 to cover the cost of the project. Funds will be appropriated in a future budget amendment.
