Councilmember Brooks has requested that the Town Attorney’s Office draft an amendment to the Castle Rock Municipal Code imposing a blanket prohibition upon all retail sales of kratom within the Town.
Notification and Outreach Efforts
The Town Manager’s Office sent notice to all local kratom retailers that the proposed Ordinance will be considered on first reading at the September 15th Town Council meeting.

June 4, 2019 - Town Council adopts Ordinance 2019-011 prohibiting sales of kratom to minors.
September 1, 2026 -Town Council directs the Town Attorney’s Office to bring a proposed ordinance amending the Castle Rock Municipal Code imposing a blanket prohibition upon all retail sales of kratom within the Town to the September 15 meeting of Town Council for first reading.
Discussion
Since the passage of a ban on kratom sales to minors in 2019, it has since come to the attention of the Town that medical authorities and federal agencies are warning that kratom products carry significant health and safety risks. Indeed, some authorities are reporting that the daily use of kratom products can cause standard opioid-like tolerance, physical dependence, and addiction within a few weeks. The proposed Ordinance makes it unlawful to sell or offer to sell at retail within the Town any kratom products intended for human consumption.

The proposed Ordinance is brought forward at the request of Councilmember Brooks; as such, no staff recommendation is given at this time.
