Title

Resolution Approving the Third Amendment to the Services Agreement between the Town of Castle Rock and Muller Engineering Company, Inc., for the McMurdo Gulch Stream Reclamation Project Priority No. 3 (Supplemental Design, Bid, Construction and Post Construction Services) [McMurdo Gulch south of  the intersection of Castle Oaks Drive and Autumn Sage Street]

Body

Executive Summary

Castle Rock Water and Parks and Recreation staff seek Town Council approval of a Resolution (Attachment A) approving the Third Amendment to the Services Agreement with Muller Engineering Company, Inc. (Muller) for the McMurdo Gulch Stream Reclamation Priority 3 Project - Supplemental Design, Bid, Construction and Post Construction Services (Exhibit 1).

The Third Amendment adds supplemental survey, hydraulic modeling, and Letter of Map Revision (LOMR) services needed to incorporate the upper two Front Range Trail crossings of McMurdo Gulch and Tributary 5 into the combined McMurdo Gulch LOMR. Because the Front Range Trail improvements overlap the hydraulic limits of Castle Rock Water's current projects, one coordinated LOMR will reduce duplicative technical work and provide Federal Emergency Management Agency (FEMA) with a consistent representation of the post-project floodplain conditions. Castle Rock Water staff worked closely with Parks and Recreation staff on the Third Amendment to develop this coordinated approach that will be more efficient and cost-effective than undertaking separate efforts.

The Third Amendment increases the agreement by $47,346, from $459,173 to $506,519, and extends the agreement through December 31, 2027. The amendment will be funded by Parks and Recreation from the Conservation Trust Fund Various Park Improvements Account No. 122-5475-452.75-18. Parks and Recreation will also provide a separate Town-managed contingency of $4,734.60, equal to 10 percent of the amendment amount, for eligible changes associated with the Front Range Trail LOMR services.

Budget Impact

Approval of the Third Amendment will increase the Muller service agreement by $47,346, from $459,173 to $506,519. The amendment is attributable to the Parks and Recreation Front Range Trail project and will be funded from the Conservation Trust Fund Various Park Improvements Account No. 122-5475-452.75-18.

In addition to the amendment amount, Parks and Recreation will provide a separate Town-managed contingency of $4,734.60, equal to 10 percent of the Third Amendment amount, from the same Conservation Trust Fund Various Park Improvements account. The total Parks and Recreation funding authorization for the Third Amendment, including contingency, is $52,080.60. The contingency may be used only for eligible changes related to the Front Range Trail LOMR services and does not increase the Muller agreement unless formally authorized.

The remaining $11,609.60 of the original Town-managed contingency will remain reserved for eligible Priority 3 construction-related changes. It is not a funding source for this Parks and Recreation amendment or its associated contingency.
