Executive Summary

 

The purpose of this memorandum is to request Town Council approval of an easement agreement (see Attachment A) between the Town of Castle Rock and Intermountain Rural Electric Association (IREA).  It is necessary for the Town to grant a 25-foot wide easement to IREA for facilities that already exist on the Town owned parcel that was annexed as the Lower East Plum Creek Annexation.  This easement was not granted by the previous land owner (Douglas County), but it was identified and had just not been executed prior to ownership being transferred to the Town.  These facilities provided service backup for the hospital and Douglas County Justice Center.  This electric utility easement originates near the existing Plum Creek Water Reclamation Authority (PCWRA) and parallels the Union Pacific Railroad until it reaches the Castle Rock Land Company’s property.  A location map is shown on Attachment B.  No fee will be received by granting IREA an easement for this Town project. Town staff requests approval of an easement agreement as part of the Lower East Plum Creek Annexation.

 

Notification and Outreach Efforts

 

There has been no notification to adjacent property owners about the Town granting this easement to IREA.  IREA installed this transmission line several years ago.  The transmission line already crosses the neighboring properties.  The dedication of this easement to IREA is needed to close out the paperwork on their project.

 

Discussion

 

During the Lower East Plum Creek Annexation, the Town received a request for an easement from IREA for existing facilities located on the property.  The IREA transmission lines were installed several years ago to provide redundancy for the hospital and the Douglas County Justice Center.  A legal description with exhibit is included with Attachment A and will be made part of the easement agreement.  This electric utility easement originates near the existing Plum Creek Water Reclamation Authority (PCWRA) and parallels the Union Pacific Railroad until it reaches the Castle Rock Land Company’s property.  This transmission line and easement are located in a different portion of the property than the planned diversion structure.  Granting this easement will have no impact on the planned improvements for the diversion structure and associated facilities.     

 

Budget Impact 

 

The Town is granting IREA an easement for existing transmission lines located on the Lower East Plum Creek property.  There will be no fee collected for granting this easement agreement.

 

Staff Recommendation

 

Staff recommends approval of the easement agreement with IREA for existing transmission lines located on the Lower East Plum Creek property.
