Ordinance Repealing and Reenacting Municipal Code Regarding Town Elections

Executive Summary
On June 16, 2026; Town Council approved an ordinance repealing and reenacting Chapter 2.01 of the Castle Rock Municipal Code regarding the conduct of Town elections. The new Election Code is attached along with the Charter to inform the Election Commission.
The Town’s election laws are found in Chapter 2.01 of the Castle Rock Municipal Code and was previously organized and focused on Town-conducted elections which are now coordinated with the County. The Code also contained deadlines for write-in candidates and canceling an election that conflicted with current statutory deadlines. Previously the Code was organized as follows:
Article I General election information
Articles II- IV Town-conducted mail ballot, coordinated, and polling place elections
Article V Campaign Finance
Articles VI, VII Election controversies and offenses
A review of the code revealed much of it was identical to the corresponding State statutes and could be eliminated. Section 4-1 of the Town Charter already requires Town elections to be conducted as coordinated elections under Title 1 of the State statutes. The Code was reorganized as follows:
Article I Election Commission, write-in candidates, canceling elections, coordinated elections, nomination process, partial terms
Article II Campaign finance, added registration of political committees and small-scale issue committees, regulation of independent expenditures, and violations
Article III New section simplifying and standardizing citizen-initiated petitions (initiatives, referendums, recall and charter amendments)
