Resolution Approving the First Amendment to the Professional Services Agreement Between the Town of Castle Rock and Dunakilly Management Group Corp., for the Fire Station 156 Construction Project

Executive Summary

 

Due to moving the station site after the contract was awarded to Dunakilly for owner’s representation, we need to amend the original agreement for cost and time.

Council has previously approved the existing agreement and this amendment takes it over the $250,000.00 limit.

 

Discussion

 

Due to moving the station site after the contract was awarded to Dunakilly for owner’s representation, we need to amend the original agreement for cost and time.

 

“Dunakilly is requesting an amendment to our contract, noted above, for additional project management services to account for project conditions differing from the parameters offered in our proposal. Specifically, the duration of the project has increased due to following, unanticipated issues encountered during design and construction:

1. Relocation of the project to the new location due to flood plain issues.

a. Design duration extended to adapt design to new location.

b. Additional earthwork scope and retaining wall construction to allow the facility to be constructed as planned.

c. Additional cost reduction efforts to achieve project budget that was not anticipated nor included in our proposal.

 

Dunakilly is requesting $137,340.00 per the following fee schedule, be added via amendment to our contract to offset the added level of effort required for this program.”

 

With this increase, we are still within budget and do not expect any additional funding requests due to this amendment.  Due to fact the expenditure now exceeds the $250,000.00 signing limit of the Town Manager, Council approval is required.

 

Budget Impact

 

The previous contract was for $160,000.00 and ended on December 31, 2026.  We are amending the contract to a new total of $297,340, and increase of $137,340.00, and extending the time to December 31, 2027.  This additional amount can be accommodated in the station construction budget without requesting an increase in the overall budget amount.

 

Staff Recommendation

 

Staff recommends approval of the amendment and cost.
