Resolution Authorizing the Chief Building Official to Issue a Temporary Certificate of Occupancy for the Unity on Wolfensberger Project [Wellspring Community, 200 Wolfensberger Road]

Executive Summary

 

The attached resolution authorizes the Chief Building Official to issue temporary certificates of occupancy (TCOs) for the Unity on Wolfensberger Project, located at 200 Wolfensberger Road, prior to final Site Development Plan approval.

 

Background

 

                     The Unity on Wolfensberger Project is a mixed-use redevelopment of the former Quality Inn & Suites by Wellspring Community, a nonprofit corporation.

                     The project includes:

o                     First floor: Wellspring’s new headquarters (approx. 16,165 sq. ft. of office space, classrooms, work opportunity spaces, pool and exercise area).

o                     Second floor: 24 for-sale condominium units, including 14 for individuals with intellectual and developmental disabilities, 6 for neurotypical individuals, and 4 for Wellspring staff.

                     On May 6, 2025, Council approved financial relief measures and authorized issuance of a building permit prior to Site Development Plan (SDP) approval, with the condition that no certificate of occupancy be issued before SDP approval.

                     The Developer now requests permission to obtain temporary certificates of occupancy in order to close on unit sales and allow residents to move in without delay.

 

Analysis

 

                     Town staff is completing final building inspections on the interior redesign, and will confirm that the condominium units are complete and safe for occupancy.

                     The only outstanding item is formal approval of the SDP; all other requirements for issuance of a TCO shall be satisfied shortly.

                     The proposed resolution grants the Chief Building Official authority to issue temporary certificates of occupancy under the following conditions:

1.                     All Town requirements for a TCO are met, except for SDP approval.

2.                     The Developer assumes all risk for proceeding before SDP approval.

3.                     No final certificate of occupancy will be issued until the SDP is approved.

 

Staff Recommendation

 

Staff recommends of the Resolution as it allows the project to move forward in serving a critical community housing need while maintaining appropriate safeguards for the Town.
