Resolution Approving an Intergovernmental Agreement Between the Town of Castle Rock and the Colorado Department of Transportation for the Construction of the Founders Parkway/Crowfoot Valley Road Intersection Improvement Project

Executive Summary

 

The Founders Parkway and Crowfoot Valley Road intersection has been identified by the Town and CDOT as an intersection experiencing an elevated accident rate, in addition to traffic congestion during peak traffic hours. The Town has been awarded a $1,602,000 grant from CDOT through the FASTER Safety Fund Program to make safety and operational improvements to the intersection. The FASTER funds will be available for fiscal year 2018 and will be applied to the construction costs of the project. Since CDOT is providing the oversight for the project, they require an intergovernmental agreement (IGA) to be entered into that outlines local agency (Town of Castle Rock) and CDOT responsibilities. The purpose of this item is to request Town Council to approve the IGA with CDOT via the attached Resolution (Attachment A). CDOT requires this agreement be executed for the IGA prior to construction commencing.

 

Right-of-way (ROW) and easement acquisitions are expected with the project. During the design phase, environmental clearances in accordance with federal and state standards are also required.

 

History of Past Town Council, Boards & Commissions, or Other Discussions

 

Staff applied for the FASTER Safety grant in November of 2014 and CDOT awarded the grant in March of 2015.  Once the funding was secured the Town was able to budget for a 2016/2017 design and a 2018 construction.  Town Council approved the project for design (2016/2017) and construction (2018) as part of the Town’s 2016-2020 Five-Year Capital Improvement Program on December 1, 2015.  Town Council approved the contract with Kimley-Horn on November 1, 2016.

 

Discussion

 

The IGA identifies the general terms of the agreement, scope of work, funding provisions awarded to the Town, and other exhibits. CDOT will be responsible for oversight throughout the design and construction of the project. The Town’s responsibilities include administration of all project phases: design, bidding, award, and construction management. After construction and acceptance by CDOT, the Town will operate and maintain work constructed behind the back of curb while the roadway and traffic signal operation and maintenance shall remain with CDOT.

 

The Town’s Attorney and Finance departments have reviewed the IGA, including the project funding provisions, and have approved it.

 

Budget Impact

 

Currently the Town has budgeted $2,384,000 in the 2018 Transportation Capital Fund.  CDOT will reimburse the Town $1,602,000 as part of their FASTER Safety Fund Program.  Approval of this resolution will not encumber funds. Encumbrance of funds will occur once the Town enters into a contract with a qualified bidder.

 

Staff Recommendation

 

Staff recommends Town Council approve the Resolution for approval of the IGA with CDOT for the Founders Parkway/Crowfoot Valley Road Intersection Improvement Project.
