Executive Summary

 

The ordinance was approved on first reading on February 4, 2025 by a vote of 7 - 0 with no changes.

 

CD-Acme, LLC (Confluence) is requesting to enter into a Development Agreement (DA) with the Town of Castle Rock for public improvements related to the property known as The Brickyard.  In addition, Confluence is requesting approval of vested property rights. 

 

The property is approximately 31 acres and is located at 401 Prairie Hawk Drive, which is north of Plum Creek Parkway and south of Topeka Way (Figure 1). 

 

The property is currently under consideration for a Planned Development (PD) rezoning under a separate land use application.  The PD proposes a mixed-use development including multi-family residential units, office, retail, restaurant and a sports center.  If the Brickyard Planned Development Plan and Zoning Regulations are approved, then Confluence must enter into a Development Agreement with the Town to define the obligations of the property owners and the Town relative to the development of the property.

 

The DA is a legally binding contract between the property owner and the Town that requires public hearings before Town Council.  Town Council is asked to consider the Brickyard PD and then the Development Agreement, and to act on first reading (Attachment A).  A public hearing for the second reading of both items is scheduled for Tuesday, February 18, 2025.

 

Staff recommends approval of the Brickyard Development Agreement, as proposed.  

 

Budget Impact

 

The Brickyard Development Agreement formalizes the developer/owner’s financial obligations to adequately address impacts of the development on Town infrastructure and services.

Staff recommends approval of the Brickyard Development Agreement and Vesting as a Site Specific Development Plan through March 1, 2045.
