Executive Summary

 

Staff recommends approval of the resolution approving the attached Pipeline Right-of-Way Grant (Attachment A), granting an easement to construct a 3-inch gas pipeline on Town-owned property in Weld County known as the Box Elder Property.  Additional details on the proposed pipeline can be found on the attached survey plat (Attachment B) and on the location map (Attachment C).

 

Discussion

 

DCP Operating Company is requesting an easement to construct a 3-inch steel pipeline along Weld County Road 4 as depicted on the attached survey plat. The survey plat shows that the portion of the pipeline to be located on the Town-owned Box Elder Property will be 1,329 feet long and will primarily be installed by open cut. The proposed pipeline will tie into an existing pipeline in Weld County Road 4 and then run parallel 10-feet off of an existing agricultural ditch except for where it will go around an existing irrigation pump.

 

The key terms of the Pipeline Right-of-Way Grant are as follows:

                     50-foot wide temporary construction easement.

                     20-foot wide permanent easement.

                     Location clearly marked with carsonite marker posts.

                     Disturbed area returned to original condition as soon as possible by DCP Operating Company.

                     Minimum depth of 48-inches so as to not interfere with farming activities.

                     Relocated by DCP Operating Company at their expense if necessitated by development of Town facilities.

                     48-hour notice to Town required by DCP Operating Company prior to accessing the property.

                     DCP Operating Company to remediate any hazardous material or other environmental contaminants introduced as a result of operation of the pipeline at no cost to Town.

                     DCP Operating Company to pay all damages to property and crops to Town or tenant as applicable.

                     Pipeline and easement to be properly abandoned by DCP Operating Company if inactive for over one year.

                     Pipeline to be maintained by DCP Operating Company.

                     Town indemnified from all liabilities and obligations.

                     Commercial general liability insurance not less than $1 million per occurrence required to be maintained by DCP Operating Company.

 

Budget Impact

 

The compensation offered for this easement is $19,950, which will be deposited into account 211-4300-395.60-00 (Misc. Revenue).

 

Staff Recommendation

 

Staff recommends approval of the Pipeline Right-of-Way Grant.
