Executive Summary
Parks and Recreation is seeking Town Council approval of a Resolution approving the Fourth Amendment to the Town of Castle Rock Services Agreement with Barker Rinker Seacat Architecture (BRS), P.C., to complete Design Development and Construction Documents for the proposed Sports Development Center for a total additional contract authorization of $2,557,366.
The Third Amendment to the Service Agreement with BRS included the first of five stages of the architectural design process: Schematic Design (SD), Design Development (DD), Construction Documents (CD), Bidding (BN) and Contract Administration (CA). Schematic Design is complete and the project is ready to move to the Design Development Construction Documents phase. Design Development will build on the Schematic Design. During Design Development (DD), materials such as doors, windows, finishes and systems are chosen, and the design is incorporated into three-dimensional imaging software to a more detailed extent than shown at SD. The Construction Document stage will follow DD where the architectural and engineering team will complete all design work necessary to prepare for competitive bidding.
The DD and CD process will run concurrently with the rezoning of the Acme Brick property as defined within the Council-approved Memorandum of Understanding (MOU) between the Town of Castle Rock and Confluence Companies dba CD-Acme, LLC (Attachment A). Terms of the MOU and any other agreement related to the Sports Center will be incorporated into the Brickyard Development Agreement and presented for Council consideration in fall 2023.
Discussion
Since its inception, the Town of Castle Rock has thoughtfully planned, implemented and maintained public recreation facilities enhancing active lifestyles, health and wellness, youth development and multi-generational social interaction. Developing indoor recreation is consistent with the Council-approved Parks and Recreation Master Plan and Strategic Plan and also ranks highly within the 2023 Castle Rock Community Survey.
Staff worked with BRS to complete an Indoor Recreation Feasibility Study beginning in 2021 through 2022. The purpose of the study was to assess community programming needs, development costs, consider operational impact and set a general timeline for the next indoor recreation facility. In October of 2022, Town Council approved an MOU with Confluence Companies (Attachment A) to consider the Brickyard as the location for the facility and the Third Amendment to the BRS Services Agreement to complete Schematic Design.
BRS will hold the prime agreement with the Town of Castle Rock for the DD and CD phases and sub-consultant agreements with all team members included in the proposal. It is anticipated that Confluence will be responsible for Bidding and Contract Administration, which will be defined within the proposed Development Agreement between the Town and Confluence.
Schematic Design has identified approximately 144,000 square feet of space between the main floor and mezzanine level of the proposed building. The overall project site for the sports development center includes 10.5 acres not including off-site detention. The facility is proposed to be the third public recreation center in the Town focused on skills development and sports competition for residents, providing an opportunity for competitive leagues and tournament play close to home. The facility will enhance health and wellness through community recreation amenities with state-of-the-art fitness equipment and programs. The recreation program established through Schematic Design is outlined below.

Sustainable Design
The project will be designed to be as sustainable as possible and will meet all local and regional building codes adopted by the town of Castle Rock. The design team shall consider all sustainable approaches that fit within the project budget; however, the project will not be following a sustainable rating program such as LEED or Green Globes.
History of Past Town Council, Boards & Commissions, or other Discussions
Staff presented a sports development center discussion/direction item to the Parks and Recreation Commission and Town Council in May 2022. At the Council meeting, staff received direction to obtain public feedback on the proposal, and staff issued an online questionnaire and hosted an open house in June 2022 at the Millhouse at Philip S. Miller Park. In October 2022, Town Council approved the Third Amendment to the BRS contract to proceed with Schematic Design and an MOU with Confluence Companies to pursue the development of a Town operated community recreation facility at the Brickyard.
Budget Impact
Proposed Facility Cost Estimate
The proposed Sports Development Center is estimated at a total project cost of $70 million. A combination of unencumbered impact fee fund balance, Certificates of Participation (COP’s) repaid through future residential development and Town sales and lodging taxes generated by the Brickyard development are proposed to fund approximately $3.5 million in annual payments over a 30-year term.
The current construction cost estimate was independently evaluated by Saunders Construction. Saunders was chosen for its successful track record for recent recreation center projects constructed in the Denver metropolitan area. Estimates were applied to the completed facility Schematic Design and will continue to be refined through Design Development. Options to either reduce programming or expand funding could be evaluated through DD to mitigate any potential construction cost or interest rate escalation.

BRS Services Agreement Budget Impact
A service agreement was originally issued with BRS to complete an Indoor Recreation Facility Feasibility Study for an initial amount of $49,879. The First Amendment to the contract with BRS for Recreation Feasibility did not modify the initial contract amount. The Second Amendment increased the contract cost by $6,390 for an amended contract cost of $56,269. $632,919 in total fees were expended through the Third Amendment for Schematic Development.
The Fourth Amendment to the Agreement will authorize an additional total of $2,557,366 for Design Development and Construction Documents. Design Development including Reimbursable Expenses are $1,241,053. Fees for Construction Drawings are $1,316,313. Overall design fees are approximately 5% of the anticipated $60 million in total project costs, which is in line with industry standards. Contract costs will be expensed to the Parks and Recreation Capital Other Professional Services Fund, account number 130-5275-452.30-70.
