Executive Summary
In recent years the Town of Castle Rock has received Community Development Block Grant (CDBG) through Douglas County’s competitive application process for funds to address needed downtown infrastructure improvements. The CDBG funds are utilized to comply with the Americans with Disabilities Act of 1990 (ADA) accessibility requirements in the Town’s historic core. The Town determined it important that the community would be able to access the services and amenities that downtown offers. The Town received $50,000 in 2015 for these improvements.
The Department of Housing and Urban Development and Douglas County are working to reauthorize Douglas County’s participation in the CDBG program. In order to complete the reauthorization, an updated intergovernmental agreement must be approved for each participating local jurisdiction that reflects the following:
Reorganizes and updates the language to reflect the statutes and regulations that apply to the CDBG
program.
Clarifies that under the CDBG program the County and Town are required to comply with the Age
Discrimination Act.
States that the Town will not sell, trade, or otherwise transfer any portion of any CDBG funds received in exchange for any other funds, credits or non-federal considerations.
Please note that compliance with the above regulations does not impact the Town of Castle Rock directly. Douglas County, as the recipient of CDBG funds, is responsible for the compliance and adhering to the regulations of the CDBG program.
Notification and Outreach Efforts
As Long Range Project Manager, Heather Lamboy (and previously Martin Hudson) represents the Town of Castle Rock on the CDBG Board with other participating jurisdictions in Douglas County (Lone Tree, Castle Pines, Larkspur, and Parker). Town staff has collaborated with Douglas County’s CDBG Program Manager regarding the required changes to the IGA.
History of Past Town Council, Boards & Commissions, or Other Discussions
The Town Council adopted the Town of Castle Rock’s Downtown Master Plan on March 18, 2008. One area of focus within the Master Plan that received a high priority among stakeholders was creating a welcoming pedestrian experience. CDBG funds have been utilized to enhance the pedestrian/alleyway experience for all individuals that live, work, or visit the downtown area. The Town has benefitted from approximately $200,000 for alley and pedestrian improvements downtown.
If the proposed IGA is approved, there may be additional opportunities for CDBG funding for infrastructure, public facilities, public services, economic development, or housing.
Budget Impact
There is no budget impact associated with the IGA Amendment.
However, in the event that a project is financed with CDBG funds, a budget amendment may be necessary because CDBG projects work on a reimbursement basis.
Staff Recommendation
Staff recommends the adoption of the Resolution approving the First Amendment to Amended and Restated Intergovernmental Agreement regarding the Community Development Block Grant Program for Urban County Years of 2016 through 2018 Administered by the U.S. Department of Housing and Urban Development.
