Executive Summary
Commissioner Katie Gasper has prepared draft accession and deaccession policies for the Town’s Public Art Collection. The Commission is asked to review the drafts, discuss the proposed criteria and procedures, and identify any desired revisions.
Final approval is not requested at this meeting. Following the Commission’s initial review, staff will incorporate the Commission’s feedback and submit the revised policies to the Town Attorney’s Office for review and comment. The policies will then return to the Commission for final consideration and approval.
Background
As the Town’s Public Art Collection continues to grow, formal accession and deaccession policies will help establish consistent, transparent and responsible procedures for accepting, managing and, when necessary, removing artwork from the collection.
Accession is the formal process through which the Town accepts ownership of an artwork and adds it to the permanent Public Art Collection. Deaccession is the formal process through which an artwork is permanently removed from the collection.
The draft accession policy establishes a process for evaluating artwork proposed for permanent inclusion in the Public Art Collection through commission, purchase, donation, gift, transfer or another approved method. The proposed evaluation criteria address artistic merit, relevance to the community, site appropriateness, public accessibility, durability, condition, maintenance requirements, public safety, collection needs and financial impacts. The draft also addresses donations, ownership, artist rights, required documentation, final acceptance, Town responsibilities, ethical standards and future relocation or deaccession. An artwork accession review form was included to help document the evaluation, associated costs, required agreements, conditions of acceptance and final recommendation.
The draft deaccession policy establishes a process for considering the removal, relocation, transfer or disposal of artwork from the Public Art Collection. It recognizes that public artwork may have a finite lifespan and that changes in condition, location, infrastructure, safety requirements or other circumstances may make continued ownership or display impractical. The draft identifies potential criteria for deaccession, including deterioration, safety concerns, excessive maintenance requirements, loss of an appropriate site, inability to relocate the artwork, expiration of its anticipated lifespan, loss of artistic integrity, ownership concerns and legal or contractual requirements.
The policy also requires consideration of reasonable alternatives before permanent removal, such as repair, conservation, relocation, temporary storage or transfer to another public or nonprofit organization. Additional provisions address disposition methods, proceeds from a sale, artist and donor notification, site-specific artwork, emergency removal, documentation, conflicts of interest and compliance with applicable laws and agreements. An artwork deaccession review form was included to document the reason for review, condition of the artwork, alternatives considered, professional evaluations, notification efforts, recommendation and final action.
Commissioners are encouraged to review both drafts in advance of the meeting and consider whether the proposed policies provide an appropriate and workable framework for managing the Town’s Public Art Collection. Discussion may include the proposed evaluation criteria, required documentation, roles of the Commission and Town staff, approval authority, circumstances requiring professional review, artist and donor notification, disposition procedures and any other areas that should be clarified or revised.
Following the Commission’s discussion, staff will work with Commissioner Gasper to incorporate the Commission’s requested revisions. The revised drafts will then be submitted to the Town Attorney’s Office for review and comment. Recommendations received through legal review will be incorporated into the drafts before the policies return to the Commission for final consideration and approval.
