Update: Castle Rock Industrial Park Development Agreement Amendment

Executive Summary
An application for a Development Agreement (DA), in conjunction with an Annexation and Zoning application, for Castle Rock Industrial Park was approved by Town Council on March 6, 2018. The approved DA inadvertently contained an obligation to convey right-of-way to the Town.
After various iterations and reviews of the development application over the course of a year, Staff determined that a sidewalk easement instead of a right-of-way conveyance was the appropriate obligation for the development application. However, the DA inadvertently left the obligation to convey right-of-way in and left out the obligation to dedicate a sidewalk easement.
Typical DA Amendments require a public hearing along with written and posted notices. Because this amendment is for the purpose of correcting an agreed upon DA item, Staff will amend the Development Agreement as indicated without further public hearing or noticing.
