Update:  Administrative Easement Grant and Right-of-Way and Easement Abandonments [Easement Grant and Right-of-Way and Easement Abandonments]

Executive Summary

 

This update is being provided to Town Council to summarize the easement grant, right-of-way abandonments and easement abandonments processed administratively by Town staff during the previous quarter.  Pursuant to Ordinance No. 2013-06 adopted on February 19, 2013 and Ordinance No. 2015-06 adopted on February 17, 2015, utility easement abandonments and unimproved street right-of-way abandonments may be approved by Town staff in conjunction with subdivision approval.  These abandonments are typically approved on the face of plats such as the ones listed in this memorandum.  Pursuant to Ordinance No. 2016-007 adopted on March 15, 2016, easements may be granted administratively by Town staff via an easement agreement (like the one listed in this memorandum) executed by the Town Manager and Town Attorney, provided that the Town receives only nominal consideration for such grant.

 

Staff will update this report when new easement grants and right-of-way and easement abandonments are approved, as Town Council requested.

 

New Easement Grant

 

The following easement was granted by the easement agreement listed below, which was recorded during the last quarter.

 

General Right-of-Way Easement to IREA - overhead and underground utility easement on Town property located within the Gateway Mesa Open Space area (Attachment A)

 

New Right-of-Way Abandonments

 

The following right-of-ways were abandoned by the subdivision plats listed below, which were recorded during the last quarter.

 

The Meadows Filing No. 20, Phase, Amendment No. 9 - Thomas Drive, Dairylide Street and a portion of Celestial Avenue (Attachment B)

The Meadows Filing No. 20, Phase 2, Amendment No. 3 - Sellman Drive, Kandinsky Circle, Umber Drive and a portion of Celestial Avenue (Attachment C)

 

New Easement Abandonments

 

The following easements were abandoned by the subdivision plats listed below, which were recorded during the last quarter.

 

Auburn Ridge, Amendment No. 1 - drainage easement located within Lot 3 (Attachment D)

The Meadows Filing No. 20, Phase I, Amendment No. 8 - portions of utility and drainage easements located within Mercantile Street (Attachment E)

The Meadows Filing No. 20, Phase I, Amendment No. 9 - all previously platted easements created by The Meadows Filing No. 20, Phase I Final Plat lying within the boundaries of this plat (Attachment B)

The Meadows Filing No. 20, Phase 2, Amendment No. 3 - all previously platted easements created by The Meadows Filing No. 20, Phase 2 Final Plat lying within the boundaries of this plat (Attachment C)

Promenade at Castle Rock Filing No. 1, Amendment No. 15 - access, utility and drainage easements within Lots 3A and 4A and New Abbey Lane (Attachment F)
