Executive Summary
Castle Rock Water (CRW) staff seeks Town Council approval of a Resolution (Attachment A) approving the Second Amendment to the services agreement with Burns & McDonnell Engineering (BMcD) for the Front Street Downtown Connection, Ray Waterman Regional Water Treatment Center (RWRWTC) Pump Upgrades and Liggett Road Pipe Upsize Projects (Exhibit 1). This proposed Second Amendment is a contract addition in the amount of $149,178 and an extension of the contract through September 30, 2026. The new revised contract amount would be $576,899 which is outside the original Council Authorization of $446,050. This will allow extension of the engineering design services to get through bid phase services and allow for Construction of the Front Street Pipeline to begin in Fall of 2025.

Discussion
This design services agreement was approved by Town Council on April 16, 2024 in the amount of $405,500, plus a Town-managed contingency in the amount of $40,550, for a total amount of $446,050. In the effort to reduce administrative and contracting costs, gain economies of scale and generate more competitive engineering bids, CRW staff combined three separate but smaller design projects into one request for proposals. Included in the scope of this design project are; a new Front Street Downtown Connection pipeline (up to 12” diameter for approximately 2,600 Linear Feet) to connect the Yellow Pressure Zone on Front Street to Wilcox Street, recommendations for upgrades to the Red Zone and Green Zone pumps at RWRWTC, and upsizing the Liggett Road Pipeline from PCWPF to the distribution system on Liggett Road to accommodate the Plum Creek Water Purification Facility (PCWPF) expansion from 6 Million Gallons Per Day (MGD) to 12 MGD, which will eliminate the bottleneck in the Town’s distribution system from PCWPF. The First Amendment was approved to add $22,221 to BMcD’s contract for additional survey required after selecting final alignments for the two pipeline projects.
As design progressed, it was recommended that a specialized geotechnical engineering team be brought on to complete a detailed trenchless design of the boring under the Union Pacific Railroad (UPRR) as part of the Front Street Pipeline design. That specific bore is on a challenging alignment with a steep grade which may require more limited methods to install. Staff recommends completing a detailed design and in-depth geotechnical evaluation during design rather than including a trenchless performance specification in the Contract Documents to reduce risk to the Town during the bidding process and construction. BMcD will be bringing on a subconsultant (GEI Consultants) to perform the specialized trenchless design and geotechnical evaluation. The proposed Second Amendment includes cost for two additional geotechnical field investigations on both the Front Street and Liggett Road pipeline alignments to further minimize risk for the proposed trenchless railroad crossings. GEI will prepare a Geotechnical Baseline Report (GBR), which will evaluate the soil borings and provide clarity and guidance for the Contractor on what below-ground conditions to expect. Recommendations for trenchless installation methodologies will also be included in the scope if needed. The proposed Second Amendment also includes additional cost to revise the RWRWTC pumping analysis memo. CRW has determined that the design points originally communicated to BMcD need to be adjusted to better align with the long-term use of the pump station. Additionally, CRW requested an analysis of the clearwell size at RWRWTC to determine if it can handle future flows from WISE or if an expansion should be considered to aid in operation of the facility and high service pumps.
Budget Impact
The proposed Second Amendment is in the amount of $149,178. This will exceed the $405,500 contract amount, plus $40,550 contingency originally approved by Council for the Front Street Downtown Connection, RWRWTC Pump Upgrades, and Liggett Road Pipe Upsize Projects. Amendment 1 increased BMcD’s Contracted amount by $22,221 and was covered by the original contingency amount. Staff recommend approving BMcD’s proposed Second Amendment in the amount of $149,178 which would bring the total contract amount to $576,899. Staff recommend retaining the remaining original contingency ($18,329) to help offset potential changes that may arise as the design of the trenchless bore under UPRR progresses. The following account information applies to all agreements related to design services for the Front Street Downtown Connection, RWRWTC Pump Upgrades, and Liggett Road Upsize projects.

Staff Recommendation
Staff recommends Town Council approval of the resolution to approve the Second Amendment to the Service Agreement between the Town of Castle Rock and Burns & McDonnell for the Front Street Downtown Connection, RWRWTC Pump Upgrades, and Liggett Road Pipe Upsize Projects in the amount of $149,178, for a total authorization amount of $595,228 (includes BMcD total contract amount of $576,899 and contingency of $18,329).
