PUBLIC HEARING

 

An Ordinance Amending the Town’s Zoning District Map by Approving the Pinon Manor Apartments Planned Development Plan and the Pinon Manor Planned Development Zoning Regulations

 

The Town Council will now consider a request for the approval of An Ordinance Amending the Town’s Zoning District Map by Approving the Pinon Manor Apartments Planned Development Plan and the Pinon Manor Panned Development Zoning Regulations.

 

In order to afford all parties due process under law, the Town Council members must be fair and impartial in deciding whether this application should be approved, approved with conditions, or denied. In making that determination, each Councilmember must consider the record, which includes the planning commission recommendation, the staff recommendation, the applicant presentation, public comment presented during the hearing, and other written public comments offered before or during the hearing. Under law, Town Council must evaluate this proposal based solely upon the record and the criteria established under the Municipal Code, which are highlighted in the staff report.  

 

It is important that each Councilmember remain objective and capable of considering information offered into the record during this hearing. 

 

Does any Councilmember believe that he or she is incapable of evaluating and voting on the application consistent with these due process requirements? If so, please describe the situation and recuse yourself from further participation on this agenda item.

Title:                     Ordinance Amending the Town’s Zoning District Map by Approving the Pinon Manor Apartments Planned Development Plan and the Pinon Manor Planned Development Zoning Regulations. 

 

 

Executive Summary

 

The applicant, Mr. Tim Peterson, is the developer and owner of Pinon Manor Apartments which is located just southeast of Downtown Castle Rock along S. Gilbert Street (Figure 1).  Mr. Peterson has purchased the triangle piece of property to the south of his apartments and has submitted an application to the Town to rezone his existing apartments and the newly acquired property to a Planned Development (PD) zone district, to be known as the Pinon Manor Apartments PD.  Mr. Peterson’s goal is to create a refreshed and distinct apartment complex which will provide housing choices to the residents of Castle Rock.  All new proposed Planned Development Plans and Development Agreements must be reviewed and approved by Town Council.

 

On May 3, 2016 Town Council voted 7-0 to approve the Pinon Manor Apartments Planned Development Plan and Zoning Regulations.

 

On April 28, 2016, the Planning Commission voted 6-0 to recommend approval to Town Council of the Pinon Manor Apartments Planned Development Plan and Zoning Regulations.

 

Budget Impact

 

The proposed Planned Development Plan will generate development review and impact fees, along with use taxes.

 

Staff Recommendation

 

On April 28, 2016, the Planning Commission voted 6-0 to recommend approval to Town Council of the Pinon Manor Apartments Planned Development Plan and Zoning Regulations.

 

Proposed Motion
