Executive Summary
The purpose of this agenda item is to seek Town Council approval of an Intergovernmental Agreement (IGA) by Resolution with the Board of County Commissioners of Douglas County (“County”) to share in the construction funding of the Four Corners Intersection Improvement Project. This IGA will commit an amount not to exceed One Million Dollars of County funds toward the cost of the construction.
The Town’s Legal and Finance Departments have reviewed the IGA, including the project funding provisions, and are recommending approval.
History of Past Town Council, Boards & Commissions, or Other Discussions
2017 Town of Castle Rock Transportation Master Plan identified the need for improvements at the Four Corners intersection.
8/3/2020 State of Colorado Intergovernmental Agreement for grant funding for the Design, Construction, Right of Way, Utilities and Environment was approved.
9/15/2020 Town Council approved Resolution 2020-091 for a service agreement contract between the Town of Castle Rock and David Evans and Associates (DEA) for the design services on the Four Corners Intersection Improvement project.
11/2/2021 Town Council approved the First Amendment to the Service Agreement for the Design of the Four Corners Intersection Improvement Project, Resolution 2021-096 with DEA.
Discussion
The Town received a federal grant to design and construct improvements at this intersection. The federal funds have been awarded as part of the regional Transportation Improvement Program
which is administered through the Denver Regional Council of Governments and the Colorado Department of Transportation.
The project is intended to improve operations at the mentioned intersection. This intersection is an important regional corridor and has been identified by the Town and CDOT as experiencing traffic congestion during peak traffic hours. The intersection operates near capacity during the PM peak period due to the high volume of traffic in the southbound direction. The southbound left turn and northbound left turn movements both experience excessive delays during the PM peak period. Traffic growth in the future will exacerbate this condition and cause similar levels of delay to the through movements on each approach.
Project remaining schedule is as follows:
• July 2022 - Right-of-way acquisitions to be completed
• Mid to late July 2022 - 90% Plans to be completed
• August 2022 - Advertisement of Bid Documents
• Fall 2022 - Award of Construction Contract and Notice to Proceed
• Fall 2023 - Construction completion
Total encumbrance budget funds identified in the IGA with CDOT for this project (Design, Construction, Environmental, Utilities, ROW incidentals or Miscellaneous) is $5,281,250.00, and broken down as follow:
• $4,225,000 (80% Federal)
• $1,056,250 (20 %Town)
Note: This does not include the funding from Douglas County in the amount of $1,000,000 as identified in this IGA.
This project is currently in the Design and Right of Way Phase of the IGA with CDOT which is identified in the IGA Option Letter from CDOT. In this Phase the funding of the project is as follows:
• $527,432 (80% Federal)
• $131,858 (20 %Town)
All non-participating cost are to be borne by the Town at 100%.
Staff at this time is projecting this project will likely exceed the current approved budget for construction, environmental, utilities, right-of-way and incidentals or miscellaneous. Staff and the design engineer are in the process of refining the engineer’s construction, construction management and right-of-way cost estimate and will be able to share that information with Town Council at this meeting. Once all of the project costs have been identified, staff is recommending to request a budget amendment that will incorporate all anticipated costs beyond the approved budget amount for approval at a future Town Council meeting.
This IGA supplements Town funds for the construction of the Four Corners Intersection Improvement Project. Construction is anticipated to begin in the Fall of 2022 and be complete in the Fall of 2023.
The IGA approval would enable the Town to apply for the Douglas County contribution of One Million Dollars within thirty (30) days after the County has received a written invoice from the Town containing a statement that CDOT concurred with the Town’s request to award a construction contract for the Project.
Project funding:
Douglas County Funds (Construction only) $1,000,000
Federal Funds (80%) $4,225,000
Town Matching Funds (20%) $1,056,250
Note: Any cost in excess of the Federal Grant will be at the Town’s cost.
Staff Recommendation
This Resolution is to be presented to the Public Works Commission on April 4, 2021. A formal recommendation from the Public Works Commission will be shared during the Town Council meeting.
Staff recommends Town Council approve the Resolution as introduced by title.
