Executive Summary
The purpose of this agenda item is to seek Town Council approval of an Ordinance to incorporate a new description of Lease Premises within the approved Zip Line and Aerial Trekking Course lease agreement between the Town of Castle Rock and Castle Rock Zip Line Tours (CRZLT). The initial lease agreement included the terms of the lease and operation plan for both zip lines and aerial trekking, but at that time, CRZLT had only completed the zip line course. As CRZLT is ready to construct the Aerial Trekking Tower (ATT), which is the final phase of their planned development, the leased premises shown in Exhibit A must be updated.
The current exhibit to the lease agreement shows only the location for the zip lines and platforms, but does include the Aerial Trekking or Epic Adventure Tower locations. In addition, it does not show the access points to the facilities owned and operated by CRZLT. The amended Exhibit A includes the location and access to all facilities operated by CRZLT within Philip S. Miller Park. No other changes or modifications to the lease agreement are proposed.
Castle Rock Zip Line Tours is ready to begin construction of the ATT, which is the final element included in the current lease agreement. The ATT is a compact high ropes course that utilizes a central platform and deck system to access climbing activities on four different levels ranging from ground level to 40’ high. See Attachment B for ATT image examples. Town Council previously approved the lease agreement, which includes lease rates and user fees for this amenity, but the location of this facility was not specified.
The location for the ATT, shown on Attachment B, will be adjacent to the upper south side of the adventure playground. This location was selected because of its compatibility with the uses established for the area originally designated as “Kinetic Canyon” that includes the adventure playground, Epic Adventure Tower and the proposed Snowflex year round snow sports area. CRZLT is working through the permitting process and with local contractors to have the ATT open by mid-May 2016.
