Resolution Setting the Date for an Election Pursuant to Statutory Mandate for the Purpose of Submitting to the Registered Electors of Town Council District No. 5 the Question of Whether District No. 5 Councilmember Renee Valentine Should be Recalled from Office

Section 15-3 of the Town Charter incorporates those provisions of state statutes governing the recall of municipal officials which do not conflict with an express requirement of the Charter. The recall of municipal officials is addressed in §§31-4-501 through 507, Colorado Revised Statutes. Staff has applied the Charter and these statutory provisions in all administrative matters related to the petition to recall Councilmember Valentine. On June 6, 2016 the Town Clerk issued the Certification of these matters to Town Council which is attached to the Resolution before Council for action.
A recall election may not be held prior to the next regulation election if the date Council addresses the recall election falls within 180 days of the regular election. Consequently, the question of the recall of Councilmember Valentine must be referred to the November 8, 2016 regular municipal election ballot, as part of the coordinated general election conducted by Douglas County.
Proposed Motion:
“I move to approve Resolution No. 2016-__ setting the date for an election pursuant to statutory mandate for the purpose of submitting to the registered electors of Town Council District No. 5 the question of whether District No. 5 Councilmember Renee Valentine should be recalled from office.”
