Executive Summary

The Parks and Recreation Department is seeking Town Council approval of the Third Amendment to the Equipment and Services Acquisition Agreement with Wilson & Company, Inc., Engineering & Architects, for Design Services for the Industrial Tributary Trail Project to increase the total contract amount by $198,918 for a total contract authorization of $1,288,039.

The first two amendments extended the term of the contract. This third amendment is necessary to address significant changes in project scope, expanded regulatory and environmental requirements, and an extended design schedule beyond the assumptions of the original agreement.

Since the original agreement was approved, the project has undergone substantial redesign of key infrastructure elements to remain within the overall budget, along with increased coordination with regulatory agencies. These changes have required additional engineering, environmental analysis, and stakeholder coordination beyond the original scope of services.

Approval of this amendment will allow Wilson & Company to complete final design, secure required approvals, and advance the project to construction.

Discussion

The Industrial Tributary Trail is a critical east-west connection identified in the Town’s Trails Master Plan, linking Philip S. Miller Park, the Castle Rock Sports Center, the Brickyard development and western neighborhoods with Downtown Castle Rock.

Since initiation of design, the project has experienced several significant changes that have increased the level of effort required to complete design and permitting. Two major design changes substantially altered the original approach. First, the planned pedestrian bridge over East Plum Creek was replaced with a low-water crossing structure. While this change helps reduce construction costs, it required additional engineering, environmental analysis, and design coordination. Second, the originally proposed tunnel under the BNSF railroad was eliminated due to cost constraints and evolving coordination with the railroad. The project will now utilize an existing tunnel, which required substantial redesign of the trail alignment, drainage systems, and supporting infrastructure.

 

In addition, regulatory requirements expanded beyond what was anticipated in the original scope. The project now requires additional environmental studies, documentation, and coordination with multiple agencies, including Colorado Parks and Wildlife and the Colorado Department of Transportation. These efforts include evaluating potential impacts to sensitive wildlife habitat, preparing supporting documentation, and ensuring the project meets state and federal requirements for environmental protection.

 

The revised design has also required more complex engineering analysis. This includes detailed evaluation of how water moves through the East Plum Creek corridor and surrounding drainage areas, coordination with floodplain requirements, and design of additional infrastructure to safely manage stormwater and protect the trail.

 

Further coordination has been necessary as the project interfaces with other ongoing efforts, including the Brickyard development, railroad operations, and utility infrastructure. These changes have required additional input from specialized subconsultants, including geotechnical and structural engineers, and increased overall coordination among project partners.

 

Finally, the project schedule has extended more than one year beyond the original timeline. This has resulted in increased project management, stakeholder coordination, and technical effort.

These cumulative changes necessitate the requested amendment to allow completion of design and permitting while maintaining alignment with the overall project budget.

 

Budget Impact

 

The proposed second amendment will increase the Equipment and Services Acquisition Agreement with Wilson & Company by $198,918, for a total contract authorization of $1,288,039. Design services will be financed through a combination of local, state, and federal funding sources, including a Transportation Improvement Program (TIP) grant administered by the Denver Regional Council of Governments, with approximately $585,000 anticipated in reimbursement.

 

This additional design effort supports a project with an updated estimated total construction cost of approximately $7.5 million, including contingency, right-of-way acquisition, and construction management. Funding for this amendment will be provided within the existing project budget allocated for the Industrial Tributary Trail, with expenditures charged to account number 110-5275-452.75-14.
